The Pan Africanist Congress of Azania (PAC) says it was clear from the beginning that there is a well coordinated agenda to remove Adv Busisiwe Mkhwebane from office.
“From the moment the Section 194 inquiry was set up, there was already a predetermined outcome of ousting Adv Mkhwebane,” the PAC claimed.
On Monday, the National Assembly (NA) adopted the report of the Committee for Section 194 Enquiry, which recommended the removal of Advocate Busisiwe Mkhwebane from her position as the Public Protector based on its findings that she had misconducted herself and is incompetent.
A total of 318 Members of Parliament (MPs) voted for the removal of Adv Mkhwebane from office while 43 voted against, and one (1) abstained.
The PAC contends that the National Assembly declared Adv Mkhwebane not fit to hold office despite three consecutive clean audits in her office during her tenure.
“It is, therefore, very difficult to ascertain the criteria used by the committee and subsequently National Assembly on unfitness to hold office. We are left with no other choice but to assume that the only criteria used for unfitness to hold office is who you investigate,” the PAC observed.
The resolution of the National Assembly will be referred to the President of the Republic, Cyril Ramaphosa, for the removal of the Public Protector from office in accordance with the provisions of section 194 (93) (b) of the Constitution.
The PAC further argued that there is an agenda to shield the current President from any scrutiny by any means necessary.
“This is seen even in how the ruling party, using its majority in the NA squashed the Phala Phala report. Anyone who dares questions Ramaphosa and those close to him pays the price,” the party said.
