The Parliament of the Republic of South Africa has issued a statement in support of its members following the utterances made by Advocate Busisiwe Mkhwebane on social media.
Mkhwebane on Wednesday posted on X saying that her ongoing struggle regarding the impeachment case “has consistently involved key figures, predominantly of Indian descent, who have positioned themselves as my persecutors”.
“These individuals include Pravin Gordhan, Bawa (Evidence Leader), Adhikarie (Chief Legal Adviser of Parliament), Hassan Ebrahim (so-called expert witness), Ivan Pillay (Witness), and Fatima Ebrahim (Legal Adviser of Parliament).
“Judge Poonan’s attitude further underscores the challenges and biases I have faced in my quest for justice,” the former Public Protector said.
This comes after her appeal in the Supreme Court of Appeals (SCA) was struck from the roll and she was ordered to pay costs.

Mkhwebane had lodged the appeal against her impeachment with the hope of seeking justice and clarity.
She wanted to appeal a Western Cape High Court ruling that dismissed her attempts to force the removal of former ANC MP Qubudile Dyantyi and DA MP Kevin Mileham from the section 194 committee that was appointed to investigate multiple allegations of misconduct and incompetence against her.
She claimed bias against Dyantyi and Mileham, who is the wife of DA MP Natasha Mazzone, saying they had to be removed due to conflict of interest.
“The unwarranted attack on these officials, along with the racial slurs used by Adv. Mkhwebane, is particularly regrettable in a democratic society such as ours, where human dignity should be protected and respected.
“As a Member of Parliament and a public representative who owes allegiance to our Constitution, Adv. Mkhwebane has a responsibility to uphold and protect the values enshrined in the Constitution, which are the cornerstone of our democracy,” Parliament stated.
Mkhwebane noted that the SCA’s decision to strike her appeal marks a significant setback for the people who believed in her role as a Public Protector.
“This experience has been one of immense disappointment and frustration, revealing a deeply ingrained bias that continues to obstruct genuine justice,” she said.
